Trump Administration Announces New AEWR H-2A Wage Rate Formula

As promised by the Trump Administration in 2017, the U.S Department Of Labor will soon file a final rule that will set the Adverse Effect Wage Rate (AEWR) for 97% of jobs in the H-2A program at the current 2020 rates through the end of 2022.  Beginning in 2023, the rates will be adjusted by the percentage of change in the Bureau of Labor Statistics’ Employment Cost Index (ECI). Once USDOL posts the final rule in the Federal Register (which is anticipated any day), it will take effect 45 days later.  To review the final rule (pre-release), click here. To review the Implementation FAQs, click here.
